NexAlign respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how information is collected, used, shared, and protected when you use the NexAlign Platform.
 

1. Information We Collect

We collect only the information reasonably necessary to operate, support, secure, and improve the NexAlign Platform.
 

1.1 Information You Provide Directly

When you create an account or use the Platform, you may provide:

• Name

• Email address

• Account login credentials

• Profile information

• Goals, routines, and progress data

• Communications with coaches or support

• Payment-related information processed by third-party providers
   

1.2 Automatically Collected Information

When you access NexAlign, certain information may be collected automatically, including:

• Device type, operating system, and browser information

• IP address

• App version and technical device information

• Usage data, such as features used, session activity, and timestamps

• Notification permission and subscription status

• Notification delivery and interaction information

• Log and diagnostic data

• App performance and error data

This information is used for platform functionality, notification delivery, stability, security, analytics, and optimization.
 

1.3 Health and Wellness Information

You may voluntarily input wellness-related information such as fitness goals, habits, reflections, workout activity, or accountability notes.

NexAlign does not require medical data and does not diagnose or treat any medical or mental health condition.

1.4 Workout Timers and Notifications

NexAlign's Workout Tracker may use device notifications to alert you when a workout rest timer has finished.

To provide these alerts, NexAlign may process limited information such as:

• Your NexAlign account identifier

• Push notification token

• Notification type

• Notification delivery time

• Limited technical identifiers associated with the notification or active timer

Active rest-timer state may also be stored locally on your device so that a timer can remain accurate if NexAlign is backgrounded, closed, or later reopened.

Workout rest-timer notifications are used only to provide the requested workout functionality. NexAlign does not transmit the contents of your goals, reflections, journal entries, coaching communications, or NexAI conversations to its notification provider solely for purposes of delivering a rest-timer notification.

2. How We Use Your Information

We use collected information to:

• Provide and operate the NexAlign Platform

• Facilitate coaching and accountability features

• Enable AI-supported guidance and navigation

• Provide requested reminders and push notifications, including daily check-ins and Workout Tracker rest-timer alerts

• Communicate with users about their account, services, or updates

• Process payments and subscriptions

• Improve platform functionality and user experience

• Analyze platform usage and performance

• Ensure platform security and prevent misuse

• Comply with legal obligations

3. AI Features and Third-Party Data Sharing

NexAlign includes an AI-supported assistant ("NexAI") designed to provide general guidance, reinforcement, and platform navigation. NexAI is powered by a third-party AI service provider, OpenAI.

3.1 What Data Is Sent

To generate personalized responses, the following personal data may be transmitted to OpenAI when you use NexAI:

• The text of your messages and chat conversations with NexAI

• Your goals, check-in responses, and reflections

• Profile context such as your name, priorities, focus areas, and success vision

3.2 Who Receives It

This data is sent to OpenAI solely to generate NexAI's responses. It is not sold or shared with other third parties by NexAlign for advertising purposes.

3.3 Your Permission

Before personal data is shared with OpenAI through NexAI, NexAlign provides an in-app consent prompt explaining what information may be sent and who receives it and asks for your permission.

You may decline, in which case NexAI remains off and information is not transmitted through NexAI. You may revoke this consent at any time under Settings → NexAI Preferences.

3.4 Data Protection

NexAlign limits information sent to OpenAI to information reasonably necessary to provide NexAI functionality and requires its service providers to handle information in accordance with applicable privacy and security requirements.

3.5 Important Limitations

• NexAI does not provide medical, psychological, or therapeutic advice.

• AI outputs are informational only and should not replace qualified professional services.

4. Sharing of Information

We do not sell user personal data.

We may share information only in circumstances including:

• With trusted service providers that support hosting, payments, subscriptions, analytics, notifications, AI functionality, or other Platform operations

• With coaches assigned to you within the Platform, solely as necessary for service delivery

• When required by law, regulation, court order, or other legal process

• When reasonably necessary to protect the rights, safety, security, or integrity of NexAlign, the Platform, or its users

Service providers are permitted to process information only as reasonably necessary to provide their respective services, subject to applicable contractual and legal obligations.

5. Third-Party Services We Use

NexAlign integrates with third-party services that support specific Platform functions.

OpenAI

Powers the NexAI assistant. When NexAI is enabled with your permission, messages, goals, check-in information, reflections, and relevant profile context may be transmitted to generate personalized NexAI responses.

Stripe

Processes subscription payments made through supported web payment flows. Payment information is processed by Stripe, and NexAlign does not store full payment card numbers.

RevenueCat

Manages native mobile subscription status and entitlements associated with purchases made through the Apple App Store and Google Play. RevenueCat receives transaction and entitlement information necessary to manage native subscriptions but does not process users' full payment card details.

Apple App Store and Google Play

Process native in-app purchases and subscriptions. Payment information used for these purchases is handled directly through Apple or Google rather than by NexAlign.

OneSignal

Provides push-notification delivery for NexAlign, including notifications such as daily check-in reminders and Workout Tracker rest-timer completion alerts.

To provide and manage notifications, OneSignal may process information including:

• Push notification tokens

• NexAlign's account identifier used to associate the correct user with a notification subscription

• Device and app information

• Operating system and app version

• Notification permission status

• Session and usage information

• Notification delivery and interaction information

• Limited notification content and technical metadata necessary to deliver and manage a notification

For Workout Tracker rest-timer alerts, notification content is limited to information needed to provide the timer alert, such as notifying the user that a rest period has finished. NexAlign does not send the contents of goals, reflections, journal entries, coaching conversations, or NexAI conversations to OneSignal solely for purposes of delivering these workout notifications.

OneSignal is used by NexAlign for Platform communications and functionality and not by NexAlign to sell personal data or conduct cross-app advertising tracking.

Firebase Analytics

Provides aggregated usage analytics used to understand Platform performance and feature usage. NexAlign configures analytics to avoid intentionally transmitting names, email addresses, health records, journal entries, or other unnecessary user-entered wellness content for analytics purposes.

Wearable Integrations

Wearable integrations such as Apple Health, Fitbit, Garmin, and similar services are not available in this release.

All health and wellness information currently used by NexAlign is entered manually by the user or generated through their direct use of NexAlign features. NexAlign does not currently collect, sync, or store information from wearable devices or health-kit services.

6. Coaches and Independent Contractors

Coaches on NexAlign operate as independent contractors and are required to:

• Maintain confidentiality

• Access only information necessary to provide services

• Adhere to Platform conduct and privacy standards

Coaches are prohibited from using user information outside the NexAlign Platform except as authorized by NexAlign and the user or as required by law.

7. Data Storage and Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information, including:

• Secure hosting environments

• Access controls

• Encrypted communications where applicable

• Restrictions on access to service credentials and sensitive backend systems

No electronic system can be guaranteed to be completely secure.

8. Data Retention

We retain personal information only for as long as reasonably necessary to:

• Provide requested services

• Maintain Platform operations

• Meet legal and regulatory requirements

• Resolve disputes

• Prevent fraud or misuse

• Enforce applicable agreements

Users may request account deletion, subject to applicable legal or operational retention requirements.

Temporary information associated with features such as active workout timers may be retained locally or operationally only as necessary to provide that functionality.

9. Your Rights and Choices

Depending on your location, you may have rights relating to your personal information, including the right to:

• Access personal information

• Request corrections

• Request deletion

• Withdraw consent where applicable

• Control whether certain optional Platform features are enabled

You may control push-notification permission through your device's operating-system settings. Disabling notifications may prevent NexAlign from delivering reminders, daily check-in alerts, Workout Tracker rest-timer completion alerts, and other push notifications, but does not prevent you from using other available Platform features.

10. Children's Privacy

NexAlign is not intended for individuals under the age of 18.

We do not knowingly collect personal information from individuals under 18.

11. Third-Party Services and Links

The Platform integrates with third-party services as described in Section 5.

Third-party services maintain their own privacy and security practices and may be subject to their own privacy policies and terms.

12. International Users

If you access NexAlign from outside the United States, your information may be processed or stored in the United States or other jurisdictions in which NexAlign or its service providers operate.

13. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in NexAlign's functionality, service providers, legal obligations, or privacy practices.

Updates will be made available through the Platform or other appropriate means and reflected by the "Last Updated" date above.

Where required by applicable law, we will provide additional notice or obtain consent before material changes take effect.
