NexAlign ("NexAlign," "we," "our," or "us") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, and protect information when you access or use the NexAlign platform, including our website, web application, mobile-wrapped application, and related services (collectively, the "Platform").

By using NexAlign, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

We collect only the information necessary to operate, support, and improve the NexAlign Platform.

1.1 Information You Provide Directly

When you create an account or use the Platform, you may provide:

  • First and last name

  • Email address

  • Account login credentials

  • Profile information

  • Goals, routines, and progress data

  • Communications with coaches or support

  • Payment-related information (processed by third-party providers; NexAlign does not store raw payment card data)

1.2 Automatically Collected Information

When you access NexAlign, we may automatically collect:

  • Device type and browser information

  • IP address

  • Usage data (pages visited, features used, timestamps)

  • Log and diagnostic data

  • App performance and error data

  • User timezone (used to deliver personalized notifications at appropriate local times)

  • Push notification tokens (used to deliver in-app and push notifications via OneSignal; collected when you enable notifications on your device)

This data is used for platform stability, security, optimization, and personalized communication delivery.

1.3 Health and Wellness Information

You may voluntarily input wellness-related information, including:

  • Mood states, mood scores, stress levels, anxiety levels, energy levels, and motivation levels

  • Workout sessions, exercise type, and duration

  • Sleep hours, water intake, caloric intake, and step counts

  • Body measurements and fitness metrics

  • Meditation and affirmation logs

  • Journal entries across physical, mental, spiritual, and accountability pillars

  • Goal progress and daily accountability check-ins

NexAlign does not require medical data and does not diagnose or treat any condition. All wellness data is provided voluntarily by you and is used solely to support your experience on the Platform.

1.4 Voice and Audio Data

When you use the NexAI voice chat feature, your voice input is transmitted to a third-party transcription service (OpenAI) for real-time processing and transcription. Audio is not stored by NexAlign beyond the duration of the interaction. Transcribed text may be retained as part of your conversation history within the Platform.

2. How We Use Your Information

We use collected information to:

  • Provide and operate the NexAlign Platform

  • Facilitate coaching and accountability features

  • Enable AI-supported guidance, check-ins, and personalized messaging

  • Deliver push notifications and in-app messages tailored to your preferences and timezone

  • Communicate with users about their account or updates

  • Process payments and subscriptions

  • Improve platform functionality and user experience

  • Ensure platform security and prevent misuse

  • Comply with legal obligations

3. AI Features and Data Use

NexAlign includes an AI-supported assistant ("NexAI") designed to provide general guidance, reinforcement, and platform navigation.

  • NexAI does not provide medical, psychological, or therapeutic advice

  • AI interactions may be used to improve system performance and personalize your experience

  • AI outputs are informational only and should not replace professional services

  • AI features are powered by OpenAI. Text inputs, voice inputs, and relevant wellness context may be processed by OpenAI under their data processing terms. User data is not used to train OpenAI's models and is not shared with OpenAI for any purpose other than generating your in-app AI responses

  • User data is not sold or used to train external AI models without explicit consent

4. Sharing of Information

We do not sell user data.

We may share information only in the following circumstances:

  • With trusted service providers (including OpenAI for AI processing, OneSignal for push notification delivery, and payment processors) under confidentiality agreements

  • With coaches assigned to you within the Platform, solely for service delivery

  • If required by law, regulation, or legal process

  • To protect the rights, safety, or security of NexAlign or its users

5. Coaches and Independent Contractors

Coaches on NexAlign operate as independent contractors and are required to:

  • Maintain confidentiality

  • Access only the data necessary to provide services

  • Adhere to platform conduct and privacy standards

Coaches are prohibited from using user data outside the NexAlign Platform.

6. Data Storage and Security

We implement reasonable administrative, technical, and organizational safeguards to protect your information, including:

  • Secure hosting environments

  • Access controls

  • Encrypted communications where applicable

No system is completely secure. You acknowledge that you use the Platform at your own risk.

7. Data Retention

We retain personal information only as long as necessary to:

  • Provide services

  • Meet legal and operational requirements

  • Resolve disputes

  • Enforce agreements

Users may request account deletion at any time. See Section 8 for instructions.

8. Your Rights and Choices

Depending on your location, you may have the right to:

  • Access your personal data

  • Request corrections

  • Request deletion of your account and associated data

  • Withdraw consent where applicable

  • Opt out of push notifications at any time via your device settings or within the Platform under Settings > Notifications

Account Deletion: You may delete your account directly within the app under Settings > Account > Delete Account, or by submitting a request to support@nexalign.app. Account deletion will result in permanent removal of your personal data, subject to applicable legal retention requirements.

9. Children's Privacy

NexAlign is not intended for individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a minor has created an account, we will promptly delete the associated data.

10. Third-Party Services and Links

The Platform integrates with third-party services including but not limited to OpenAI (AI processing), OneSignal (push notifications), and payment processors. NexAlign is not responsible for the privacy practices of external services or websites. We encourage you to review the privacy policies of any third-party services you interact with.

11. International Users

If you access NexAlign from outside the United States, you acknowledge that your data may be processed and stored in the United States or other jurisdictions where NexAlign or its service providers operate. By using the Platform, you consent to this transfer.

12. Changes to This Policy

We may update this Privacy Policy periodically. Updates will be posted within the Platform and reflected by the "Last Updated" date. Continued use of NexAlign after changes constitutes acceptance of the revised policy.
